  1. Conclusion of the Brokerage Agreement
    By making use of our brokerage services, in particular by requesting an exposé, entering into negotiations, or viewing a property, a brokerage agreement in text form pursuant to Section 656a of the German Civil Code (BGB) is concluded.
    The agreement does not require a handwritten signature. Text form (e.g. email) is sufficient.
  2. Nature of the Service
    Von Hirsch – Immobilien am Bodensee GmbH acts as a listing broker and/or intermediary broker.
    We are entitled to act on a commission basis for the other contractual party as well (dual agency), provided there is no conflict of interest and both parties have been informed accordingly.
  3. Offers
    Our offers are subject to change and non-binding.
    They are intended exclusively for the respective recipient.
    Disclosure to third parties is permitted only with our prior written consent. In the event of unauthorized disclosure that results in the conclusion of a contract, the entitlement to commission remains unaffected.
  4. Commission

4.1 General Principle
The entitlement to commission arises upon the conclusion of a legally effective principal contract (purchase agreement or lease agreement).
The commission becomes due upon notarization of the contract.

4.2 Residential Properties (Single-Family Homes & Condominiums)
When brokering single-family homes or condominiums to consumers, the following applies:
The commission is shared equally between buyer and seller, provided both parties have commissioned the broker on a commission basis (Sections 656c, 656d BGB).

A unilateral burden on the buyer is excluded if the seller is also a consumer.

The specific commission amount is stated in the respective exposé.

4.3 Building Plots and Commercial Properties
For building plots, multi-family houses, commercial properties, or investment properties, the commission may be agreed individually.
Unless otherwise agreed, the commission amounts to:
3% – 6% of the notarized purchase price plus statutory VAT.

4.4 Lease Agreements
Residential Leases:
The “commission by the client” principle applies (Section 2 para. 1a WoVermRG).
The commission is borne exclusively by the party placing the order.

Commercial Leases:
Up to three net cold monthly rents plus statutory VAT, unless otherwise agreed.

  1. Due Date and Continuation of Commission Claim
    The entitlement to commission remains valid even if the principal contract is subsequently rescinded or reversed for reasons not attributable to us.
  2. Prior Knowledge
    If the client is already aware of the offered property, this must be communicated to us immediately, at the latest within five calendar days, in text form and substantiated accordingly.
    If no such notice is given, the property shall be deemed to have been introduced by us.
  3. Equivalent Transactions
    The following are deemed equivalent to the conclusion of a purchase agreement:

  1. Liability
    Property information is based on details provided by the seller or third parties.
    We assume no warranty for the accuracy or completeness of such information.
    Our liability is limited to intentional misconduct and gross negligence.
    Claims arising from injury to life, body, or health remain unaffected.
  2. Valuation
    Upon request, we provide a market value analysis.
    Unless expressly agreed otherwise, this does not constitute a court-certified appraisal.
  3. Referral Bonus
    For the successful referral of a sales mandate, we pay a bonus of €1,000.00 gross.
    The entitlement arises upon conclusion of a notarized purchase agreement and payment of the commission.
    A legal claim exists only if agreed in writing in advance.
  4. Data Protection
    The processing of personal data is carried out in accordance with our privacy policy.
  5. Final Provisions
    The place of performance is the registered office of Von Hirsch – Immobilien am Bodensee GmbH.
    The place of jurisdiction – insofar as legally permissible – is the registered office of our company.
    Should any provision of these GTC be invalid, the validity of the remaining provisions shall remain unaffected.
